Thammy Tours & Travel is a Tour Operator licensed by the Indonesian Government, Licence No:....... The Law of the Republic of Indonesia shall apply in the event of any Claim or Legal Action arising as a result of any Booking with Thammy Tours & Travel. Thammy Tours & Travel is not an Agent of airlines or shipping companies, but we are pleased to be able to offer airline tickets and other Travel Services if requested. We reserve the right to change our Terms & Conditions at any time with or without notice and we will inform you of any changes as soon as possible.

It is your responsibility to read carefully and understand our Terms & Conditions. Together with your Booking Form and Deposit, our Terms and Conditions forms a legal Contract. TOUR PRICES

Tour Prices Quoted on our Brochures are Valid until 31 March 2011. Group Rates can be negotiated. We will be happy to Quote for Customised Tours. EXTRA CHARGES CAUSED BY CIRCUMSTANCES BEYOND OUR CONTROL

Thammy Tours Travel reserve the right to charge extra for price increases caused by circumstances beyond our control such as changes in tax rates, Government legislation, fuel surcharges or excessive currency fluctuations. You agree to pay such charges when requested.

B O O K I N G

BOOKINGS PROCEDURE

Bookings should be made on our on-line Booking Form. Please fill in all the details requested. We require Bookings to be made at least six weeks (42 days) before start of your requested Tour dates.

DEPOSIT

A Deposit of 30% of the Total Tour Price is payable at the time of your Booking. On receipt of the correct Deposit in our Bank, your Reservation becomes a Booking and we will send you a Booking Confirmation Number which should be quoted in all correspondence with us. We will also send you a Travel information Form which asks details of Travel Insurance, Passport numbers for all Travellers, Airport destination, Flight Number and Arrival time. This Form should be sent to us at the time of Tour Balance 3 weeks before Tour Commences.

BALANCE OF TOTAL TOUR PRICE

The Balance of Total Tour Price becomes payable into our Bank Account 3 weeks (21 days) prior to start of your Tour.

RE-CONFIRMATION

On receipt of Balance and Travel information we will send you a Re-Confirmation and your Booking becomes a Final Booking.

A Single Supplement charge will be levied on single Travellers.
Triple Share - may be available if requested.
Families and Children - Discounts of 25% for children under the age of 8.
Groups - With a Group of 16 people or more, the Group Leader goes Free.

PRICE INCLUSIONS

Meeting and greetings to welcome you at airport, transport to Hotel, accommodation per night, breakfast per person, Guides and Car, bottled water for car, entrance fees, Tours as described in our Brochures or Tours as required by Guest.

PRICE EXCLUSIONS

Travel insurance, airfares, airport taxes, excess baggage charges, passport and visa charges, vaccination charges, meals and drinks unless stated on Itinerary, laundry, porterage, gratuities, telephone charges, and other items of a personal nature. Equipment for Scuba diving and snorkelling is excluded. Thammy Tours & Travel reserves the right to change Itineraries with or without notification due to safety considerations or unforseen circumstances. Guests are responsible for extra charges if they wish to change the Itinerary while on the Tour.

LATE BOOKINGS

Thammy Tours & Travel can accept late Bookings, however these are subject to a Late Booking Fee.
High Season : May - September, Booking within 3 weeks of start of Tour: US $ 65 per person.
Low Season: October - April, Booking within 2 weeks of start of Tour: US $ 50 per person.
Full Payment of Total Tour Price must be made immediately.

T R A V E L I N S U R A N C E

It is a requirement of participation on all Thammy Tours & Travel that all Guests have adequate Travel Insurance in place.Travel Insurance should cover Personal Liability, personal accident and medical expenses, evacuation and repatriation, baggage and personal items loss, and cancellation or curtailment of holiday.

SPECIAL NOTE

All participants in our Scuba Diving, Snorkelling and White Water Rafting Tours will need to have High Risk Sports Insurance. TRAVEL INSURANCE POLICY NUMBER and NAME OF INSURER is required to be supplied to us at time of Payment of Total Tour Balance, 21 days before commencement of Tour. If details are not supplied to us by 14 DAYS before Tour start date, Thammy Tours & Travel will have no option but to Cancel your Booking.

CANCELLATIONS

A Cancellation Fee of 30% of Total Tour Price is applied if notification of Cancellation by you the Guest is received by us 14 DAYS OR LESS before the start of Tour. This means your Deposit becomes non-refundable. Cancellations caused by non- receipt of Tour Balance by 14 days of commencement of Tour, or non- provision of Travel Insurance details as requested by us , will also result in a Cancellation fee charged at 30% of the Total Tour Price.

REFUNDS

Refunds of your Deposit and/or Balance of Tour Price will be effected by Bank transfer within 4 weeks of your notification of Cancellation, less any Bank charges such as Administration Charges, tax and service charges, Bank Transfer charges, or substantive changes in rates of exchange with the Indonesian Rupiah. Your Deposit will not be refunded in the event of Cancellation by you for any reason within TWO WEEKS OF THE START OF THE TOUR. No refunds can be given for any unused portion of a Tour or any non-participation in the Itinerary.

CLAIMS

We hope you enjoy your Tour with Thammy Tours & Travel. However, if for any reason you wish to make a Claim, please notify us as soon as possible and make your claim in writing within 30 days of the end of your Tour.

THAMMY TOURS AND TRAVEL LEGAL LIABILITY DISCLAIMER

Thammy Tours & Travel is an Agent for and Contractor with other Tour Operators in Indonesia to supply services. Thammy Tours & Travel acts as contractor only for the persons or companies providing or offering the Tour, the means of transport, accommodation or other services (the Suppliers) and all receipts, tickets, vouchers and coupons are issued subject to the Terms and Conditions under which such transportation, accommodation, goods and services are offered by such persons and companies. To the extent permitted by law, Thammy Tours & Travel excludes all liability in respect of any acts, errors, omissions, representations, warranties, breaches or negligence of any such Suppliers or for any personal injury, death, property damage, baggage loss or other expenses resulting from the supply of goods and services by these Suppliers or by any Third Party. Thammy Tours & Travels disclaims all liability and will make no refund in the event of any delay, detention, loss, damage, sickness or injury, cancellation, overbooking, strike, force majeure, riot or civil commotion, natural disaster or other cause beyond its direct control, and will have no responsibility for any additional expense caused by omissions, delays, re-routing or acts of any government or authority.

VISA AND PASSPORT

Prior to your departure you must obtain a Tourist Visa from the Indonesian Embassy in your country. Your Travel Agent will help you apply. Allow at least 14 days for processing. Proof of Return or Through Airline Ticket will be required on application. Your Passport should be valid for at least 6 months beyond the date of entry into Indonesia. If it is not you should apply for Renewal as soon as possible. Please note that your Passenger Name submitted on your Booking Form must be the same as the name in the Passport.

INDEMNITY

You agree to indemnify, and keep indemnified, Thammy Tours & Travel and any of its officers, employees and agents from and against any claims, causes or action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind arising in relation to any action, inaction or omission by you including, without limitation, your breach of:
